Section 1 – general statement

This is end user service agreement between you („user“) and Jan Drozd software company („provider“) located at Prague, Na Okraji 129/70, ID 76344444.

By using our TeamSpeak service („service“) (available on jandrozd.eu, jdsw.cz) you agree to be bound by these terms of service.

These terms may be updated from time to time. Provider will notify about changes in this documents on the website jandrozd.eu.

Section 2 – basic terms

2.1 Price of service

The service is completely non commercial and thus provided completely free.

2.2 Service availability

As the service is provided completely free, we cannot guarantee the service availability for you.  However, we do our best to provide stable communication platform for you

2.3 Exclusion of commercial activities and critical communications

This server MUST NOT be used for any kind of commercial activities, including, but not limited to advertisement of 3rd party products and services. This service cannot be used for critical communication with government or any other state entity or person acting in the name of state. Violation of this term will result in permanent ban.

2.4 Minimal age for use of this service

User must be at least 16 years old. If you are under 16, you must obtain parent’s or guardian’s  permission to use the service (according to GDPR). If you want to become a moderator or administrator, you must be at least 18 years old. Provider can make an individual exception regarding minimal age to become moderator or administrator.

Section 3 – general rules of conduct

3.1 NO SPAM

Never send bothersome messages to users who do not want it. You must not repeatedly enter chat rooms and disturb other users by such action or by use poke function.

3.2 Freedom of speech

Freedom of speech is one of the biggest values of democratic states. Please behave with respect to freedom of speech. People can have different opinions.

3.3 Ban of religion or political agitation

 This service must not be used for any religion or political agitation. This rule does not ban free discussion of politics or religion if the users wish to discuss it.

3.4 Ban of unlawful content

It is forbidden to use the service to transmit any illegal content. If we detect such activity, it will result in permanent ban. Such activity will be reported to law enforcement authorities if it fulfills the conditions of the obligation to discharge the law.

3.5 Ban of „toxic“ activities

The service is primarily dedicated to computer game players. Each player is otherwise experienced and this can affect your experience. However, we do not think it is right that a friendship breaks down just because of different gaming experiences. Some users may try, not only for the above reasons, to induce conflicts and damage friendly user relationships. Above all, through slander, aggressive behavior and the aggressive promotion of their views. Such behavior will not be tolerated.

Section 4 – extended rules of conduct

4.1 Public rooms recording ban

It is not permitted to record other users in public rooms, no matter if you use service integrated features or any other software. All users in the private room must agree with the eventual recording. Consent should be expressed in the recording itself.

4.2 Ban of use of identity of other user

It is not permitted to use identity of other users. Always use your own identity/nickname.

4.3 Ban of voice changers

It is not permitted to use voice changing software. The only exception if all users within the one room agrees with the use of such app.

4.4 Prohibition of abuse of complaint function The service allows you to file a complaint with another user. If the reports limit is exceeded, the user is temporarily excluded from usage of the service. However, this function may be misused, for example, in violation of these conditions, section 3.5. Such abuse will not be tolerated.

Section 5 – moderator and administrator rules

5.1 Identity validation

Anyone who is interested may become a moderator or administrator after consulting the server owner and identity validation. Anyone who wants to become a moderator must provide:

  • Name and surname
  • Own and verifiable mobile phone number
  • Own and verifiable e-mail address

Depending on request, provider may ask for more personal information to be able to make decision if the moderator/administrator permission should be granted.

Only the provider or a person authorized by the provider shall decide on the award of the oderator or administrator permissions. The request may be rejected without giving any reason. But we mostly try to be the most open and explain everything.

5.2 Usage of special permissions

The moderator and the administrator can decide to set up chat rooms, kick and exclude users from using the service. In the event that you are given the administrator or moderator permissions, you agree to abide by the rules herein. You may not use special permissions to resolve personal issues, attacks on other users. You may use special privileges in good faith only; you may give a ban only if the user violates these terms and permissions. If you encounter inappropriate behavior, but not listed here, consult your decision with the server owner first.

5.3 Reputation of provider and service

A user who becomes a moderator or administrator will not harm the provider’s and/or service reputation, even if he / she ceases to be an administrator or moderator for any reason.

5.4 Protection of privacy of standard users

In the event that the user becomes a moderator or administrator, he / she will gain access to some personal user data. Above all, it is the IP address of the user who needs it to perform its function. Administrator and moderator are committed to maintaining the confidentiality of data (not just IP addresses) that they obtain. The moderator or administrator who violates this term may become subject to legal sanction under applicable law.

Section 6 – privacy policy

6.1 Data collected when using the service

The Provider may collect certain personal information necessary for the provision of the service. These data are mainly:

  • User IP address
  • Moderator or administrator contact information (described in section 5.1)

6.2 Personal data protection

The collected data is only available to the provider, in the case of IP addresses as well as to administrators and moderators. The Provider is committed to protect the data received and not to pass it on to third parties except in the circumstances listed.

6.3 GDPR compliance

In accordance with valid European legislation, you have the right of deletion of personal data from the provider’s database. In case you want to use this option, please contact provider via e-mail at [email protected]

 Section 7 – resolution of complaints

In case you would like to request unban, please follow our unban policy.

Section 8 – exclusion of liability

IN NO EVENT SHALL THE SERVICE PROVIDER OR CONTRIBUTORS, MODERATORS AND ADMINISTRATORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF THE SUBSTITUTE GOODS OR SERVICES, OR LOSS OF USE, DATA, OR PROFITS; BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
